1.Acceptance of Terms
By accessing or using UniSwipe ("the Platform", "we", "us"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all Terms, you must immediately cease using the Platform.
These Terms constitute a legally binding agreement between you and UniSwipe (registered in the Netherlands). We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
Your use of the Platform is also governed by our Privacy Policy, which outlines how we collect and process your personal data in strict compliance with the General Data Protection Regulation (GDPR).
3.Accounts & Eligibility
To use UniSwipe you must:
- Be at least 18 years of age or the age of majority in your jurisdiction.
- Be currently enrolled at, or a recent graduate of, a recognised university.
- Provide accurate, current, and complete registration information.
- Maintain the security of your password and immediately notify us of any unauthorised use.
- Not create more than one account per user.
UniSwipe reserves the right to suspend or terminate any account that violates these Terms or that we reasonably believe poses a risk to other users or the Platform.
4.Tutor Obligations
By registering as a Tutor, you agree to:
- Provide truthful information about your qualifications, university, programme, and academic record.
- Submit only genuine transcripts and academic credentials for verification.
- Deliver tutoring sessions to the best of your ability and as described in your profile.
- Honour booking commitments and provide reasonable notice of cancellations.
- Comply with all applicable laws and university academic integrity policies.
- Not provide answers to assessed coursework, examinations, or assignments on behalf of students.
5.Student Obligations
By registering as a Student, you agree to:
- Use tutoring services only for legitimate academic learning and support.
- Not request tutors to complete, write, or substantially contribute to your assessed work.
- Treat Tutors with respect and not engage in any harassing or abusive behaviour.
- Pay for booked sessions promptly and through the Platform only.
- Provide honest and fair reviews of Tutors based on your genuine experience.
7.Payments & Fees
All financial transactions on UniSwipe are processed securely through Stripe. By making or receiving payments, you agree to Stripe's Terms of Service.
UniSwipe charges a platform service fee on each tutoring transaction. The fee percentage depends on the Tutor's subscription plan:
- Basic (Free) Plan: 10% platform fee per transaction.
- Premium Plan: 5% platform fee per transaction.
- Pro Tutor Plan: 0% platform fee — tutors keep 100% of earnings.
Refunds are handled on a case-by-case basis in accordance with our Refund Policy. UniSwipe reserves the right to hold funds for up to 14 days after session completion before releasing to the Tutor.
Subscription fees for Premium and Pro plans are charged monthly and are non-refundable once the billing period has commenced, except where required by applicable consumer law.
7.1 EU Right of Withdrawal
Under EU consumer law, you have a statutory right to cancel a digital service or subscription within 14 days without giving any reason. However, by booking a tutoring session that is scheduled to take place within this 14-day cooling-off period, you expressly request and consent to the service beginning before the end of the withdrawal period, and you acknowledge that you will lose your right of withdrawal once the tutoring session has been fully performed.
8.User Content
By submitting content to UniSwipe (including profile descriptions, reviews, messages, and uploaded documents), you grant UniSwipe a non-exclusive, royalty-free, worldwide licence to use, display, and store that content for the purposes of operating the Platform.
You warrant that any content you submit: (a) is accurate; (b) does not infringe any third-party rights; (c) does not contain defamatory, offensive, or unlawful material; and (d) complies with these Terms.
UniSwipe reserves the right to remove any content that, in our reasonable opinion, violates these Terms or applicable law.
9.Intellectual Property
All UniSwipe branding, software, design, and proprietary content are the exclusive property of UniSwipe Ltd. Nothing in these Terms transfers any intellectual property rights to users.
You may not reproduce, distribute, modify, or create derivative works from any part of the Platform without our express written consent.
10.Termination
You may close your account at any time from your account settings. UniSwipe may suspend or terminate your account for any of the following reasons:
- Breach of any provision of these Terms.
- Fraudulent, abusive, or illegal activity.
- Failure to pay outstanding amounts owed to UniSwipe.
- Extended inactivity (accounts inactive for more than 24 months may be closed).
Upon termination, your right to use the Platform ceases immediately. Sections 6, 9, and 11 survive termination.
11.Limitation of Liability
To the maximum extent permitted by law, UniSwipe is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to: loss of earnings, data loss, academic consequences, or disputes between users.
UniSwipe's total liability to you for any claim arising from these Terms or your use of the Platform shall not exceed the total fees paid by you to UniSwipe in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
12.Governing Law
These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Enschede, the Netherlands, without prejudice to any mandatory consumer protection rights you may have under your local law.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
Online Dispute Resolution (ODR): For consumers residing in the European Union, the European Commission provides an Online Dispute Resolution platform, which can be accessed at https://ec.europa.eu/consumers/odr.
